MEMPHIS, TN -

(WMC-TV) - An art teacher at Highland Oaks Middle School in southeast Shelby County was on paid leave by the end of the school day Friday and a 12-year-old student was with his mother at a Baptist Minor Medical Center.

"I send him to school to learn, not to get assaulted," said parent Lisa North.

North wanted a doctor to check out her son's head after he claimed the teacher pushed his head onto a desk during a confrontation over a burst ink pen.

"Like a real bad headache," said Cortez Brown.  "Like right here on my forehead."

Brown said the teacher then kicked him in the rear end when he tried to get a paper towel in order to clean up the ink.

"The principal called me and said my son was in an incident with his teacher," said North.

She said the teacher was gone by the time she got to the school.

A spokesman for Shelby County Schools confirms the teacher is on paid administrative leave while an internal investigation proceeds.

Meanwhile, the Shelby County Sheriff's Office launched an investigation of its own which could result in criminal charges.

A spokesman for the sheriff's office told Action News 5 the teacher would likely be questioned in the coming days.

"She needs to go to jail," said North.  "Be prosecuted to the fullest."

Brown said he never expected anything like this to happen in art class.

Action News 5 has decided not to name the teacher unless criminal charges are filed.
