Judge appointed to hear Mayor Greg Davis' case

SOUTHAVEN, MS -

(WMC-TV) - It took a few weeks to find one after several judges declined the appointment, but Southaven Mayor Greg Davis now knows who will hear the case against him.

Mayor Davis is accused of using blue flashing lights to pull over another car that ignored school bus stop signs.

"It's not like a citizen was out running blue lights on their vehicle and we believe that's what the statute intended," said Defense Attorney Steve Farese. "We'll have a defense and it'll be up to the judge to make the decision."

But which judge?

That has been the obstacle for weeks, especially since Davis is involved in another legal matter over questionable spending habits.

"All five justice court judges have recused themselves from hearing the Greg Davis case," said DeSoto County Justice Court Clerk Shirley Beshears.

After several other area judges declined the appointment, an order from Circuit Court Judge Bobby Chamberlin came down Thursday.

Tallahatchie County Justice Court Judge Steve Ross will hear the case.

Charleston is one of two county seats. It is just about 70 miles south of Southaven, straight down Interstate 55.

"So it's certainly the prescient thing to do," said Farese. "I feel it's something that puts everyone on a level playing field and that's all anybody wants, both the prosecution and defense."

With the defense and judge now set, Davis is awaiting his day in court. A prosecutor has yet to be selected to handle the case.
