(WMC-TV) - Southaven Mayor Greg Davis is at the center of a lawsuit, and this is not the first time.

This time around, he is being sued by the Miss. state auditor who could stop his paychecks.

As soon as today you could see Southaven Mayor Greg Davis file a Temporary Restraining order to keep the state from touching his paycheck.

The lawsuit was filed in Hinds County Court, and is the latest development in a drama that has been playing out for months.

In a surprise visit to Southaven yesterday, Miss. State Auditor Stacey Pickering addressed the Board of Aldermen telling them it is time for Davis to pay the remaining $73,000 he owes his city.

Davis says the money was spent for tourism, but state leaders say  that is not the case. They say the money went to alcohol, fancy meals, travel and an adult store in Canada.

Mississippi's state auditor says the lawsuit is an effort to finally get things resolved.

During the meeting, the state auditor also handed the board a check for the $96,000 that Davis has already paid.

As far as the rest of the money, the auditor says Miss. code allows his office to garnish Mayor Davis' paychecks from this point forward until the balance is paid.

Meanwhile Mayor Davis claims he does not owe any money and is eager for his day in court.
