MEMPHIS, TN -

(WMC-TV) – Kenneth Whalum Jr., Shelby County School Board Commissioner, is not backing down. Attorneys for Whalum are headed back to court today to fight for a recount in the Aug. 2 election.

Whalum's lawsuit names each member of the Shelby County Election Commission. It claims the commission issued incorrect ballots and refused to allow voters with proper ID to vote.

Whalum lost his District four seat by just a few dozen votes to Kevin Woods.

Whalum's attorney, Robert Spence, told Action News 5 the hearing will discuss a possible settlement or a date for a trial. Whalum is not expected to be there.
