Officer Lang's husband battles court for custody of kids

MEMPHIS, TN -

(WMC-TV) - Tuesday is the day a circuit judge would have granted the divorce between the late Memphis Police officer Martoiya Lang and her husband, Darius.

Despite Martoiya Lang's death, that hearing still took place.

Lang's attorney says a circuit judge still has a few concerns about the custody of her children and her estate.  She says the matter is still not over in court.

Neither Darius Lang nor his attorney had anything to say as they left the courtroom.

Earlier this month, Lang was named administrator of his late wife's estate.

Now, he is fighting to keep custody of his children.

"There were allegations of abuse. In fact, Ms. Lang was asking for supervised visitation for their children," said Martoiya Lang's attorney Felicia Corbin-Johnson.

Corbin-Johnson says Judge Donna Fields wants to analyze the law before granting the divorce.

She says Darius Lang wanted divorce proceedings dismissed after Martoiya Lang's death.

The couple was supposed to go into mediation the week after Martoiya Lang was killed.

"We certainly want what's best of the children," added Lang's attorney.

Attorneys on both sides of the issue are scheduled to file briefings in the matter next Wednesday.  They are scheduled to be back in court next Thursday at 9 a.m.
