MEMPHIS, TN -

(WMC-TV) – A mother and her son are both facing charges after police believe the mom told her son to get a gun during a fight with her husband.

When police responded to the 900 block of Estridge Drive Wednesday, they found Stephen Houston had been shot in the head.

Police said 40-year-old Leslie Mann-Houston was involved in a physical fight with her husband when she told her 16-year-old son to get a gun.

The woman and her son are both charged with aggravated assault.

"He was alive he was sitting up, and he was holding something on his face," said neighbor Daniel Westpy. 

Hours after the teenager was taken into custody, police charged his mother with aggravated assault for ordering the shooting.

"I'm thinking it went in one cheek and out the other," said neighbor Eli Eyse. 

Neighbors say the victim is a former marine.
    
Stephen Houston remains in critical condition at The MED.

Police said Houston and his wife have no prior history of domestic violence.

Leslie Mann-Houston is in jail on an $85,000 bond.

She's due in court Friday.
