MPD officer fired after deadly crash could end up back on the job

MEMPHIS, TN - (WMC-TV) – As a family continues to grieve the loss of their loved ones, there are new details that the Memphis officer who is accused of killing them could end up back on the job.

Alex Beard has been collecting a pay check during the investigation. And even though he was fired, he still has options to challenge that dismissal.

"I miss them every day, Michael Ross said. "I think about them every day. I break down and cry. But I thank the Lord I'm here every day."

Michael Ross lost his daughter, 13-year-old Mackala Ross and his fiancée Deloise Epps in August last year when they turned in front of Memphis Police officer Alex Beard. Investigators say Beard was heading East on Crump responding to a call for backup but did not have his lights or siren on.

Michael Ross was driving when they were hit by Beard's squad car. The Ross and his family were visiting from Senatobia for a relative's 50th birthday party.

Alex Beard has been off the job for six months and has gotten paid while the investigation by the highway patrol was underway, an investigation that ended with his firing on Monday.

"I always prefer to do it right," Memphis Mayor A C Wharton said. "It might take a long time, but once you make a decision you have a better chance of having it upheld, if you don't rush."

Alex Beard joined the police department in March 2011.  He can appeal his firing through civil service or arbitration.

"You get an independent party to look at all of the circumstances surrounding his firing and they will determine whether the city is in good faith or not," Michael Williams, president of the Memphis Police Association said.

As a member of the Police Association, Beard will also get an attorney for any court cases. He has not been charged criminally in the case. The District Attorney is still investigating. 

It is not clear if Beard will appeal his firing.
