GALLATIN, TN (WSMV) -
Lawyers are battling over what a jury should hear about what a Hendersonville mother allegedly did before and after she was accused of killing her newborn twins.
Lindsey Lowe's trial is set to begin next week, and legal teams on both sides are already fighting every step of the way with pre-trial motions.
Lowe faces two counts of first-degree murder and aggravated child abuse in the September 2011 smothering deaths of the children in her parents' Sumner County home.
Lowe appeared in court Tuesday and sat silently as her defense attorney argued on her behalf about the pages and pages of text messages she exchanged with the father of her twin boys.
Prosecutors argued the texts showed premeditation on Lowe's part in the twins' deaths. They also want the judge to exclude Google searches on Lowe's computer, but we don't know yet what those searches were.
"There were certain text messages back and forth and some Google searches as well. They're a technical thing we feel like might be of great evidentiary value for the jury," said Sumner County District Attorney Ray Whitley.
The defense also wants the judge to allow testimony from a psychiatrist about Lowe's state of mind during the alleged crime. Her attorney said she was suffering from a mental condition but wouldn't specify what it was.
The judge will rule on these motions Monday when Lowe's trial is scheduled to begin.
