GALLATIN, TN (WSMV) -
A Sumner County woman accused of killing her twin boys is just days away from the start of her murder trial, and Thursday a judge made a ruling in favor of the state.
Police say Lindsey Lowe hid her pregnancy, smothered the infants right after they were born and hid their bodies in a laundry basket at her parents' Hendersonville home in 2011.
Now, the jury in this high-profile case will be allowed to see text messages between Lowe and the father of her newborn twins.
She was engaged at the time of the alleged murders, but DNA evidence proved her fiance was not the twins' father.
Prosecutors contend the texts between Lowe and the boys' father show the crime was pre-meditated, and they believe she murdered the children to cover up the affair.
"It establishes the nature of the relationship between Jeremy Smith and Lindsey Lowe, and it will come out in trial why that's important," said Sumner County District Attorney Ray Whitley.
However, Lowe's defense team fought to keep the texts out of court, claiming they're irrelevant to the case.
"The text messages are relatively innocuous. They don't prove anything that's contested," said defense attorney John Pellegrin.
Lowe's defense team said while the woman wasn't insane at the time of the crime, they do say she suffered from some sort of mental condition
They aren't saying what that condition is, but they hope to present testimony from a psychiatrist about her state of mind.
Jury selection will begin Monday, as lawyers have 180 potential jurors from whom to choose.
Lowe's defense has asked for a change of venue, and the judge is still considering that motion. Also, the jurors will not be sequestered during the trial.
