Accused murderer still has rights to deceased wife's assets

MEMPHIS, TN -

(WMC-TV) - Although he is behind bars, Patrick Spencer still has control over his deceased wife's accounts, leaving her children scrambling to pay for their mother's burial.

Lisa Spencer was killed without a will, so her children need her accused killer's signature to access their mom's assets.

Daughter Jacqueline Davenport is consumed with grief.

"I won't ever get to talk to her again. She's not going to be able to go to our weddings, she's not going to be able to see our kids," she said.

Justin Davenport, Lisa's son, admits the situation doesn't make sense.

"How are you going to kill somebody, even though it's your spouse, and then turn around and you've still got full rights?" he asked. "We're trying to get it set up to where they freeze the accounts so he can't do anything with it."

Patrick Spencer is in jail on a $500,000 bond. Members of his family have not responded to Action News 5's attempts to contact them. Spencer is due in court July 17.
