'Interest of rehabilitation' releases five young gang rape suspects

MEMPHIS, TN -

(WMC-TV) - Gang rape charges against five Memphis boy were reduced Monday in juvenile court. This comes four months after the alleged attack on a mentally disabled 13-year-old girl.

All five suspects are all 15 years old or younger; one is only 10 years old. Charges were reduced from rape to aggravated sexual battery.

The boys were charged with raping the 13-year-old girl inside a vacant home off Rolling Hills Drive in Frayser.

"Went to court today and the charges were reduced to sexual battery ... One was dismissed," said chief probation officer Barry Mitchell.

Mitchell said charges were dropped against the 10-year-old because of his age. Mitchell hopes they gets on the right track so they will not return.

According to court records, the 10-year-old, two older cousins, and two other friends admitted to luring the alleged victim into the vacant house where she was forced to perform sex acts on all five boys.

But despite the seriousness of the charges, a DA's office spokesman said the below in statement:

"The defense and the prosecution came to an agreement, that based on the evidence and the interest of rehabilitation of these youngsters, it would be best to prosecute on the lesser charge of aggravated sexual battery."

The four older boys were all released on probation. One of the boys could face sex offender treatment based on his prior record.

The others will be evaluated at the end of their probationary period.
