Acquitted murder suspect reunited with mother

MEMPHIS, TN -

(WMC-TV) - After three years behind bars, Joshua Cline walked out of prison into his mother's arms.

Cline walked away from a possible death sentence after a jury acquitted him Saturday of the ax murders of his uncle and his uncle's girlfriend.

The couple were killed in their home near the University of Memphis campus.

"It's extremely rare, across the country, for a client who is facing the death penalty to get an acquittal," stated defense attorney Gerald Skahan.

But, it is not so rare in Shelby County. Just last year, Ealrode Davis, who claimed self defense, was acquitted in a sword death of James Donley.

Skahan said the jurors did their job in the Cline case.

"I think they looked at it and said, 'Maybe he could have done it and maybe 10 others could have done it.' And that's not enough," said Skahan.

Skahan said there was not any evidence presented at trial that tied Cline to the murders.

Prosecutors were not allowed to present what they considered a confession because the judge said it came after Cline came out of a coma when he was still heavily medicated.

According to Skahan, the coma was caused by the drugs and alcohol Cline had taken. Skahan continued to state Cline was not making sense when he talked with police.

"He made such statements [like] he was born on October 36 [and] that he was in Bermuda," declared Skahan.

Cline said he made it though thanks to his family.

"My family has been with me the whole way," Cline said.
