MEMPHIS, TN -

(WMC-TV) - The man accused of driving drunk and causing the car wreck that killed a 13-year-old has issued an apology and privately "reached out" to the victim's family, according to his defense attorney.

Quincy Johnson, 27, is charged with DUI and vehicular homicide. Sunday morning, Hezekiah Keyon Moss died from injuries he sustained in the crash.

"He is so sorry and has reached out to the Moss family and has conveyed his condolences," says Johnson's defense attorney Leslie Ballin.

"He's a good young man in a terrible, terrible situation. He recognizes that there's been a loss of life and he's charged with it. He's going to act appropriately and do what is appropriate under the circumstances."

Ballin continued, "It's early on in the case. We know the family is going through a grieving process and our hearts and prayers go out to them at this time."

On Monday night, Hezekiah's uncle, Pastor Linwood Dillard, expressed concern over Johnson being out on bond.

"We're very, very outraged," he said. "To me, if a person drives drunk on time, he'll most likely do it again."

Since then, Johnson made a second bond of an additional $200,000.

Ballin says Johnson will be in court and does not have any prior convictions.

"There's no danger of him getting out and committing any other crime while out on bond. He's in court and the bond was set appropriately," said Ballin.

As for the apology, Action News 5's Nick Kenney was unable to reach the Moss family.

Johnson is due back in court Friday morning.

Hezekiah Moss' funeral is scheduled for Saturday.
