Montgomery's new towing ordinance starts Saturday

MONTGOMERY, AL (WSFA) -

The new towing ordinance for the city of Montgomery will go into effect Saturday.

The Montgomery City Council passed the ordinance in November. Under the ordinance, if a driver is involved in an accident and they do not have a driver's license or auto insurance the driver will be ticketed by police and the vehicle will be towed.

Under the ordinance, officers will check to see if the driver has a valid license, insurance and registration as required by state law. Officers will also use the state's online verification system to immediately confirm insurance. This online system helps officers statewide in enforcing the Alabama Mandatory Liability Insurance Law. If the online system verifies that a vehicle is insured, the officer will accept that verification even if the driver can't provide proof of insurance.

A friend of family member may deliver a driver's proof of insurance. Officers will also accept proof of insurance from insurance companies through a driver's smart phone or tablet.

If a crashed vehicle is impounded, it will be towed and stored in a service garage, storage lot or other place of safety determined by the chief of police.  A vehicle release document will be issued after proof of insurance, vehicle registration, valid driver license are verified and a $50 processing fee is paid.

If the vehicle is not picked up 60 days after being towed it may be advertised and sold by the towing company.

According to Police Chief Kevin J. Murphy, the aim of the ordinance is to protect all motorists by reducing the number of unlicensed, uninsured drivers on city streets.
