(WMC-TV) - Prosecutors have secured the first grand jury indictment against a DNA profile—commonly referred to as a John Doe indictment—based on the results of testing one of the thousands of backlogged rape kits.

(WMC-TV) - Prosecutors have secured the first grand jury indictment against a DNA profile, commonly referred to as a John Doe indictment, based on the results of testing one of the thousands of backlogged rape kits.

The suspect is unknown, identified only as a DNA profile, which has been entered into a national database. If that DNA profile ever shows up in another case and a suspect is identified, he or she will face rape charges at 201 Poplar. This eliminates any concerns over the statute of limitations.

"We know this is the person who committed the crime, we just don't know their name," said District Attorney General Amy Weirich. "Science can tell you this DNA profile is unique to this individual. The step now and the next thing is for that person to be identified, arrested, and brought to justice in Shelby County."

Prosecutors did not reveal details of the case.

Weirich says so far 2,266 of the backlogged sexual assault kits have been sent off for first-level serology testing. About 40 percent test negative for usable DNA.

The roughly 60 percent that test positive will be sent for further testing.

Since 2011, all sexual assault kits have been getting sent off for testing at the time they are collected. The 12,000-plus backlogged kits are still working the way through first-level testing.
